Draft Planning Scheme Amendment C52pryn

The Pyrenees Shire Council have been working with the Wimmera, Glenelg Hopkins, and North Central Catchment Management Authorities on flood studies which aim to improve flood resilience and preparedness throughout the Shire.

These studies are informed by historical information, physical conditions, computer modelling and local knowledge. They have identified properties that are likely to be affected by flooding in the localities of Waubra, Raglan, Lake Goldsmith, Mt Emu, Mena Park, Chepstowe, Landsborough, Moonambel, Elmhurst, Eversley, Navarre, Barkly, Crowlands, Avoca, Glenlofty, Glenpatrick, Rathscar, Amphitheatre, Natte Yallock, Tanwood, Redbank and Warrenmang and rural areas along the Avoca River. As a result, Council has drafted flood-related planning controls for a proposed amendment to the Pyrenees Planning Scheme.

The Draft Amendment C52pyrn seeks to implement the findings and recommendations of these flood studies by introducing and applying the Floodway Overlay (FO) and/or Land Subject to Inundation Overlay (LSIO) and removing the Design and Development Overlay (Schedule 1). These overlays aim to mitigate future risks associated with potential riverine flooding events.

What Flood Studies have been undertaken?

Council and the relevant Catchment Management Authority (North Central CMA, Wimmera CMA, and Glenelg Hopkins CMA) have adopted the:

These studies and the relevant Regional Floodplain Management Strategies recommend that flood planning controls be updated in the Pyrenees Planning Scheme.

What areas will be affected by the Amendment?

The Amendment will affect over 1600 properties in the Shire.

Raglan Flood Investigation (2020)	The Amendment applies to land in the township of Raglan and surrounds (figure 2). The draft amendment proposes to introduce the Floodway Overlay and Land Subject to Inundation Overlay.
Upper Avoca Flood Study (2021)	The Amendment applies to land in the townships of Avoca, Amphitheatre, and surrounds (figure 3). The draft amendment proposes to introduce the Floodway Overlay and Land Subject to Inundation Overlay, and remove the existing Design and Development Overlay.
Upper Wimmera Flood Investigation (2014)	The Amendment applies to land in the townships of south Navarre, Barkly, Landsborough, North Elmhurst, North Eversley, Crowlands, and surrounds (figure 5). The draft amendment proposes to introduce the Floodway Overlay and Land Subject to Inundation Overlay, and remove the existing Design and Development Overlay.
Upper Mount Emu Creek Flood Investigation (2020)	The Amendment applies to land in north of Skipton, Lake Goldsmith and surrounds to Langi Kal Kal (figure 4). The draft amendment proposes to introduce the Floodway Overlay and Land Subject to Inundation Overlay.
Waubra Preliminary Flood Study (2019)	The Amendment applies to land in the township of Waubra and surrounds (figure 6). The draft amendment proposes to introduce the Land Subject to Inundation Overlay.

What will this Planning Scheme Amendment do?

The Draft Planning Scheme Amendment implementing these overlays takes a precautionary approach to ensure any land use and development in the overlays adequately considers flood risk.

This means any future building, works and subdivisions may require a planning permit as land included in the overlay needs to be assessed for flooding hazards before works can begin.

At the Council meeting on 17th March 2025, Council agreed to consult with the community regarding the Flood Study Planning Scheme Amendment.

Following the engagement period, the draft controls may inform an amendment to the Pyrenees Planning Scheme, called Draft Amendment c52pyr.

The SAC will only consider submissions relevant to land use planning, or to the purpose and content of Draft Planning Scheme Amendment C52pyr. The SAC is not required to consider the technical methodology used to prepare flood studies or flood mapping.
